They aimed to reduce Ripple’s $125 million penalty to $50 million and lift the injunction against Ripple preventing institutional XRP sales. However, on May 15, the judge dismissed the motion as procedurally improper, citing their failure to invoke the correct federal rule and to show “exceptional circumstances” under Rule 60(b). Stuart Alderoty, Ripple’s Chief Legal Officer (CLO), confirmed that the dismissal did not undermine previous legal victories or XRP’s status and was only a procedural error. Rather than accept defeat, the parties refiled the motion on June 12. The new version addresses Judge Torres’ concerns and again requests lifting the institutional sales injunction and a $75 million return to Ripple after the SEC payment. Both parties backed up their stance with established precedents and are seeking an indicative ruling. Fred Rispoli, a popular attorney who predicted the joint motion filing , noted that filing before the June 16 deadline would make the Second Circuit extend the status report deadline by another 60 days rather than resuming appeal proceedings. If Judge Torres grants the new motion, both parties are expected to move to dismiss the appeals in the Second Circuit, paving the way toward final settlement procedures. With the joint motion resubmitted, the court has the opportunity to resolve the four-and-a-half-year-long case and bring Ripple and XRP close to freedom from legal troubles.
